High Court Halts Criminal Trial in Kamoga Land Dispute
Kamoga faces eight counts initiated by Peter Babigamba over a disputed 200-acre land in Katabi town council, Wakiso. Accusations include forgery and obtaining registration through pretense. Kamoga appealed to the High Court, claiming the criminal proceedings amounted to the criminalization of a land dispute.
Justice Isaac Muwata observed that the civil division and Court of Appeal had jurisdiction over land disputes between Kamoga and Babigamba. Pending civil suits could impact criminal proceedings, risking conflicting decisions. The judge stressed the higher courts’ role in determining the legality of Kamoga’s actions, ensuring a comprehensive resolution within the legal framework.
