In May 2023, Uganda’s Parliament enacted the highly controversial Anti-Homosexuality Act, triggering global condemnation for its discriminatory provisions targeting the LGBTIQ+ community. The law criminalizes same-sex relationships and activities, creating a hostile environment for LGBTQ+ individuals and serving as a basis for infringing on broader human rights. A recent report by the Strategic Response Team (SRT) meticulously documents the human rights violations resulting from this legislation.

Key Findings: The SRT report highlights the severe violations of human rights that have occurred since the passage of the Anti-Homosexuality Act:

  1. Right to Housing and Shelter: The report reveals a disturbing 180 cases of evictions affecting LGBTQ+ individuals and families. Driven by discrimination and prejudice, these evictions have left many vulnerable individuals homeless, stripping them of a fundamental human right and exposing them to further risks of violence and exploitation.
  2. Freedom from Torture and Degrading Treatment: A staggering 176 cases of torture and abuse have been documented, ranging from physical violence to psychological trauma. These violations, perpetrated by both state and non-state actors, not only contravene Uganda’s constitution but also damage the country’s international reputation.
  3. Right to Equality and Freedom from Discrimination: The report lists 159 instances of violations against the right to equality and freedom from discrimination. Systemic discrimination has left LGBTQ+ individuals marginalized, impacting their access to essential services like education, healthcare, and employment.
  4. Mental Health Impact: The psychological toll on the LGBTIQ+ community has been significant, with 102 cases of mental health issues reported. The pervasive discrimination, violence, and social exclusion faced by these individuals have led to widespread psychological trauma, underscoring the urgent need to address the human rights violations at the root of these issues.

The Anti-Homosexuality Act 2023 has resulted in profound human rights violations against Uganda’s LGBTIQ+ community, affecting their right to housing, freedom from torture, equality, and mental health. The international community and human rights organizations must continue to press the Ugandan government to repeal this discriminatory law and to establish a more inclusive society that respects and protects the rights of all individuals. The fight for LGBTQ+ rights in Uganda represents a broader battle for human rights and dignity.
